Building Before Breaking: The European AI Enforcement Landscape and the Case for Proactive Competence

I have spent the past two years watching organizations try to adopt AI. The pattern is remarkably consistent. A firm deploys a tool. Someone uses it without understanding what it does. Something goes wrong. A regulator or a judge responds. The profession issues guidance. Everyone scrambles to comply.
This is the American model of AI governance, and it has dominated the global conversation. Mata v. Avianca in June 2023. State bar opinions cascading across fifty jurisdictions. The ABA's Formal Opinion 512 in July 2024 — telling lawyers what they must do after AI was already in courtrooms. It is governance by reaction. Rules after problems. Sanctions after failures. Guidance after the damage is done.
Europe chose differently. And the choice was not accidental — it was architectural.
When the EU AI Act's Article 4 mandated AI literacy as its first binding obligation — effective February 2, 2025, before any other substantive provision — it made a statement about regulatory philosophy. Build competence before deployment. Ensure people understand what they are using before they use it. Do not wait for professionals to fail and then punish them. Build the infrastructure that prevents failure.
This is what we see when we read the enforcement record assembled in this white paper. Every case — every GDPR fine, every hallucination sanction, every copyright dispute — traces back to the same root cause: someone deployed AI without sufficient understanding of what it does, what it cannot do, and what obligations surround its use. These are not technology failures. They are competence failures.

The Two Approaches: America Reacts, Europe Builds
The transatlantic divide in AI governance is not merely a difference of timing or severity. It is a difference of philosophy — and that philosophical difference has profound implications for how organizations should prepare.
The American Model: Governance by Reaction
The American approach to AI in professional practice follows a consistent sequence: deployment, failure, sanction, guidance.
Mata v. Avianca set the template in June 2023. Lawyers used ChatGPT to draft a brief. The brief contained fabricated case citations. The court imposed a USD 5,000 fine. Headlines followed. State bars began drafting guidance. But the guidance arrived after the tool was already in widespread use. The Morgan & Morgan sanctions followed a similar pattern. So did dozens of subsequent cases across federal and state courts.
The ABA's Formal Opinion 512, published in July 2024, was the profession's most authoritative response — a formal statement that lawyers' existing duties of competence, diligence, and candor apply to generative AI use. It was important. It was also fourteen months after Mata. The opinion told lawyers what they should have known before they ever opened ChatGPT in a professional context.
As of early 2026, more than thirty US state bars have issued AI guidance, but these pronouncements vary in specificity, enforceability, and approach. Some require disclosure of AI use; others merely recommend it. Some impose specific verification obligations; others rely on existing competence rules. The result is a jurisdictional mosaic — fifty different answers to the same question, none of them coordinated, most of them issued after the problems they address had already occurred.
This is not a criticism of the American legal system. It is a description of a regulatory philosophy: let innovation proceed, then address failures as they emerge. It works, eventually. But it works at the cost of real harm to real people — clients who received fabricated legal analysis, judges whose time was wasted on nonexistent authorities, professionals whose careers were damaged by tools they did not understand.
The European Model: Infrastructure Before Incidents
Europe did not wait for an AI hallucination in a courtroom to start building its governance framework. The infrastructure was already in place years before generative AI entered professional practice.
The General Data Protection Regulation, enacted in 2016 and effective since 2018, gave data protection authorities the tools to regulate AI systems before any AI-specific legislation existed. Italy's Garante used GDPR to suspend ChatGPT in March 2023 — not because there was an AI law, but because there was a data protection law that was already comprehensive enough to reach AI.
The Court of Justice of the European Union built algorithmic accountability doctrine through preliminary references — binding interpretations of EU law that apply across 27 member states simultaneously. No waiting for the right case in the right court. No fifty different answers to the same question.
And then Article 4. The EU AI Act's architects made AI literacy the first binding obligation — effective February 2, 2025, six months before general-purpose AI model obligations and eighteen months before high-risk system requirements. The sequencing was deliberate. Before you deploy, you understand. Before you operate, you learn. The regulation builds the floor of competence before the building goes up.
This is the approach we align with at TwinLadder. Not because we are European — though we are — but because the evidence in this white paper demonstrates that proactive competence infrastructure prevents the failures that reactive governance can only punish.
Part I: The GDPR as AI's First Regulator

Before the EU AI Act existed even as a legislative proposal, European data protection authorities had already begun regulating artificial intelligence. They did so using the GDPR — and they did so with a creativity and aggressiveness that fundamentally shaped how AI companies operate in Europe. Understanding this enforcement landscape is essential context because the AI Act does not replace GDPR-based AI enforcement. It supplements it.
Italy's Garante: Setting the Standard
The most consequential early enforcement came from Italy's Garante per la protezione dei dati personali. On March 31, 2023, the Garante became the first data protection authority in the world to order the suspension of ChatGPT, citing violations of GDPR Articles 5, 6, 8, 13, and 25. OpenAI restored service approximately one month later, after implementing age verification, enhanced privacy notices, and user objection mechanisms — but the regulatory relationship was far from over. In December 2024, the Garante imposed a EUR 15 million fine on OpenAI for processing personal data without an adequate legal basis, failing to provide sufficient transparency, and neglecting age verification obligations.
The fine was modest by Big Tech standards. Its significance lay in the precedent: a national regulator successfully applied pre-existing data protection law to constrain the most prominent AI system in the world. No new legislation was needed. The infrastructure was already there.
The Garante's enforcement extended further. In February 2023, the authority imposed a EUR 5 million fine on Replika, an AI chatbot marketed as a virtual companion, for processing personal data of minors without adequate safeguards and for handling emotional and psychological data without the explicit consent required under GDPR Article 9. The Garante reasoned that an AI system designed to engage users in intimate emotional conversations necessarily processes data revealing psychological states — and that such data warrants heightened protection regardless of whether the AI "understands" what it processes.
What we see in the Garante's pattern is not merely enforcement. It is infrastructure building. Each decision established principles that subsequent enforcement could build upon. This is the European model in action: create the precedent base before the crisis reaches full scale.
Real-Time Intervention: Ireland's Emergency Powers
Ireland's Data Protection Commission, the lead supervisory authority for most US technology companies operating in Europe, demonstrated a different enforcement approach: emergency intervention rather than retrospective fines. In August 2024, the DPC obtained an emergency court order suspending X's (formerly Twitter's) processing of EU user data for training the Grok AI chatbot. The order required X to immediately cease using EU users' posts and interactions as training data.
This was not a fine imposed months after a violation. It was a real-time injunction stopping AI training as it occurred. The DPC subsequently secured similar pauses against Meta, demonstrating that emergency powers could be deployed repeatedly and against multiple companies. European regulators can intervene while the competence failure is happening, not merely after it has produced consequences.
Germany's Automated Decision-Making Enforcement
Germany's data protection authorities contributed enforcement actions focused on automated decision-making. Hamburg's authority imposed a EUR 492,000 fine on a financial services company for making automated credit decisions without adequate human oversight or meaningful explanation of the decision logic — applying GDPR Article 22 directly to AI-driven credit scoring. Bavaria's BayLDA ordered Worldcoin (now World) to delete biometric iris scan data collected from EU residents, holding that the company's consent mechanisms were insufficient for the sensitivity of the data involved.
Each of these cases tells the same story from a competence perspective. The organizations that were fined did not fail because the law was unclear. They failed because they deployed AI without understanding the regulatory framework that already governed their use of personal data. The GDPR had been in effect for five years when most of these enforcement actions commenced. The rules were there. The competence to follow them was not.
The EDPB Framework: From Scattered Actions to Coherent Policy
The culmination of this enforcement activity came in December 2024, when the European Data Protection Board adopted Opinion 28/2024 on data protection aspects of AI models. This opinion represents the most comprehensive authoritative statement on how GDPR applies to AI, addressing when AI model training can rely on legitimate interest as a legal basis, how purpose limitation applies to models trained for one purpose but deployed for another, what data minimization means in large-scale AI training, and under what conditions an AI model itself should be treated as personal data.
Opinion 28/2024 transformed scattered national enforcement actions into a coherent, Union-wide regulatory framework for AI data protection. It provides the interpretive scaffold that national DPAs will use going forward. For any organization deploying AI in Europe, this opinion is not optional reading — it is the compliance baseline.
The GDPR articles most effectively applied to AI enforcement deserve specific attention because they continue to operate alongside the AI Act. Article 5's data processing principles provide foundational standards against which any AI system processing personal data is measured. Article 6's lawful basis requirements have made the legitimate interest test under Article 6(1)(f) the primary battleground for AI training legality. Article 9's restrictions on special categories of data have constrained AI systems processing biometric, health, and racial or ethnic data. Article 22's restrictions on solely automated decision-making have been the primary tool for challenging AI-driven decisions affecting individuals. And Article 25's data protection by design requirement has been invoked to require AI developers to build privacy protections into systems from the outset rather than retrofitting them after deployment.
An AI system deployed in Europe must comply with both the GDPR and the AI Act. A violation of one may compound liability under the other. European AI governance already operates through multiple overlapping frameworks, and the complexity will only increase.
Part II: The CJEU Builds the Algorithmic Accountability Framework
The Court of Justice of the European Union has been quietly constructing an algorithmic accountability framework through its preliminary reference procedure — the mechanism by which national courts refer questions of EU law to the CJEU for binding rulings. Two landmark decisions and several pending references are shaping jurisprudence that governs AI across all 27 member states. Practitioners who focus only on national court decisions are missing the most consequential legal developments.
SCHUFA: The Functional Test for Human Oversight
The SCHUFA decision, Case C-634/21, issued in December 2023, is the foundational ruling. SCHUFA Holding AG, Germany's dominant credit scoring agency, assigned a score to a consumer whose credit application was subsequently rejected. The CJEU held that automated credit scoring falls within GDPR Article 22 when three cumulative conditions are met: the decision must be based solely on automated processing; the processing must include profiling; and the decision must produce legal effects or similarly significantly affect the data subject.
The ruling's critical contribution is the functional test for human involvement. The Court held that a credit score determines outcomes regardless of whether the credit institution retains formal discretion to override it. Where the score is the decisive factor in practice, the decision is based solely on automated processing even if a human nominally reviews it. Human oversight must be meaningful, not merely nominal.
This functional test extends far beyond credit scoring. It applies to any AI system that produces outputs used as the primary basis for decisions affecting individuals — including AI-assisted legal analysis, employment screening, insurance underwriting, and risk assessment. The CJEU effectively told Europe: putting a human in the loop is not enough. The human must actually be in a position to understand and meaningfully evaluate the AI's output.
This is where the competence thesis becomes unavoidable. Meaningful human oversight requires that the human possess sufficient understanding of what the AI system does, how it reaches its outputs, and where it can go wrong. The SCHUFA ruling does not use the phrase "AI literacy." But it describes exactly what Article 4 later mandated: sufficient understanding to exercise genuine judgment over AI outputs.
Dun & Bradstreet: The Right to Understand
The Dun & Bradstreet decision, Case C-203/22, issued in February 2025, extended the SCHUFA framework by addressing what individuals are entitled to know about how automated decisions are made. A data subject requested information about automated credit scoring logic. The credit reference agency refused, citing trade secret protection.
The CJEU held that GDPR Articles 13, 14, and 15 — which require "meaningful information about the logic involved" in automated decision-making — impose a substantive transparency obligation that cannot be defeated by blanket trade secret claims. Controllers must provide sufficient information for individuals to understand the main factors that influenced the decision and to challenge decisions they believe are incorrect.
For organizations deploying AI systems that affect individuals, the practical implication is immediate: you must be able to explain what the system considered and how it reached its output. This obligation exists regardless of whether the methodology constitutes a trade secret. Explainability is not optional — and building explainability into AI systems after deployment is both technically difficult and legally risky.
The Dun & Bradstreet ruling reinforces the competence thesis from the deployer's perspective. An organization cannot explain its AI system's decision logic to a data subject if its own personnel do not understand that logic. Transparency to the outside requires competence on the inside.
Pending References: The Framework Expands
Several pending CJEU references will extend this framework further. Case C-806/24, referred by a Bulgarian court, represents the first preliminary reference involving interpretation of the EU AI Act itself. The case will provide the CJEU's initial guidance on how the AI Act's provisions interact with existing EU law — including, critically, the GDPR.
Case C-250/25, referred by a Hungarian court, addresses whether large language model training constitutes reproduction under EU copyright law and how the text and data mining exception applies to generative AI. A CJEU ruling on these questions would harmonize the fragmented national approaches that have emerged in Germany, the UK, and elsewhere, providing definitive guidance across all 27 member states.
The emerging CJEU jurisprudence represents something more significant than individual case outcomes. It represents the construction of a coherent, Union-wide framework for algorithmic accountability — one that applies uniformly, builds on existing fundamental rights jurisprudence, and coexists with the AI Act's purpose-built provisions. This is infrastructure. It is being built methodically, across years, through the careful accumulation of binding precedent.
Part III: The Verification Crisis — When AI Hallucinations Reach Courts
The wave of lawyer sanctions for AI-fabricated citations that began with Mata v. Avianca in the United States reached European courts in 2025. But the European response followed a distinctly different path — one that reveals the structural difference between reactive and proactive governance.
The English Cases: Professional Failure, Not Courtroom Misconduct
The most significant European AI hallucination cases emerged in June 2025. In Al-Haroun v QNB, solicitors submitted a skeleton argument containing multiple fabricated AI-generated case citations. In Ayinde v London Borough of Haringey, solicitors similarly submitted AI-generated citations that could not be verified. Across the two cases, 18 fabricated citations were identified — exceeding the fabricated citations in Mata and suggesting heavy reliance on AI output without any meaningful verification.
The judicial response diverged sharply from the American model. Rather than imposing monetary sanctions directly, the English judges made referrals to the Solicitors Regulation Authority. This procedural choice reflects a fundamental philosophical difference. In the American model, the fabricated citation is treated primarily as a violation of court rules — an affront to the tribunal addressed through the court's sanctioning power. In the English model, it is treated primarily as a failure of professional competence and integrity — a matter for the professional regulator.
The distinction matters because regulatory referrals engage a different enforcement mechanism with different consequences. The SRA's sanctions toolkit includes reprimands, fines, conditions on practice, suspension, and striking off. More importantly, SRA proceedings generate published decisions that create professional norms, influence insurance premiums, and shape expectations across the entire profession. A USD 5,000 fine from a federal judge may be treated as a cost of doing business. An SRA investigation that results in published findings about a solicitor's failure to verify AI outputs creates a professional standard that every solicitor in England and Wales must heed.
I want to be direct about what these cases represent, because the profession's framing of them matters. These are not "AI failures." ChatGPT did not fail. It performed exactly as designed — it generated plausible-sounding text. The professionals failed. They lacked the competence to understand that a large language model generates text based on statistical patterns, not legal knowledge. They did not know that verification is not optional when working with generative AI. They did not have the literacy that Article 4 now mandates.
Eighteen fabricated citations across two cases. That is not a technology problem. That is a training problem. And it is precisely the training problem that Europe's proactive approach — building literacy requirements before widespread deployment — is designed to prevent.
The Garfield.Law Precedent: Preventing Rather Than Punishing
The SRA's authorisation of Garfield.Law Ltd as the first purely AI-based regulated law firm in May 2025 illustrates the proactive European approach in microcosm. The SRA authorised the firm with specific conditions designed to prevent hallucination — most notably, the restriction that the system would not propose relevant case law, which the SRA identified as a high-risk area for LLM errors.
The SRA did not wait for Garfield.Law to produce a fabricated citation and then sanction it. The regulator identified the risk, built the safeguard, and imposed it before the firm commenced operations. This is building before breaking.
Part IV: Copyright and AI Training — Europe's Jurisdictional Battleground
The question of whether AI training on copyrighted works constitutes infringement is being answered differently in every European jurisdiction that has addressed it. The fragmentation creates acute uncertainty, and it will persist until the CJEU provides harmonizing guidance.
GEMA v OpenAI: Output-Side Liability
The most significant ruling came from the Munich Regional Court in November 2025. GEMA, the German collective rights organization for music publishers, sued OpenAI alleging that ChatGPT reproduced memorized copyrighted song lyrics. The court ruled in GEMA's favour: where an AI system has memorized copyrighted content and reproduces it in response to prompts, the reproduction constitutes infringement.
The court drew a critical distinction between AI training and AI output. Even if the initial ingestion of copyrighted works for training falls within the text and data mining exception under Article 4 of the EU DSM Directive, the output-stage reproduction of memorized content is not shielded. The TDM exception permits reproduction for analytical processing, not for generating outputs that replicate the mined content.
For practitioners advising AI companies, this means compliance cannot focus solely on training data acquisition. It must address the risk that trained models will memorize and reproduce protected content, and it must implement technical safeguards — output filtering, memorization detection — to prevent infringing reproductions.
From a competence perspective, the GEMA ruling underscores what organizations need to understand about how AI systems work. A professional who grasps that LLMs store statistical patterns derived from training data — and that these patterns can produce near-verbatim reproductions — will approach AI outputs with appropriate caution. A professional who treats AI as a magical black box will not. The difference is literacy.
Getty Images v Stability AI: The Territorial Gap
In Getty Images v Stability AI, the UK High Court addressed a preliminary jurisdictional question that significantly narrowed the scope of copyright claims. Because Stability AI's model training was conducted on computing infrastructure located in the United States, the court held that the training-stage reproduction — even of UK-copyrighted works — did not occur within UK territory and therefore could not constitute infringement under UK law.
The ruling creates a territorial asymmetry: rightholders whose works are scraped from UK sources and used for AI training in the US may have no remedy under UK copyright law, while the same activities on UK-based servers would potentially be actionable. The ruling has been criticized as creating a perverse incentive for AI companies to locate training infrastructure outside Europe.
Kneschke v LAION: The Opt-Out Mechanism
The Hamburg Regional Court's December 2025 decision addressed practical requirements for rightholders who wish to opt out of text and data mining. The court held that to effectively reserve rights under DSM Directive Article 4, rightholders must use machine-readable means — robots.txt directives, metadata tags, or similar technical mechanisms. A general website statement asserting that content may not be used for AI training, if not machine-readable, is insufficient.
The ruling creates reciprocal obligations: rightholders must implement technical opt-out mechanisms, and AI training systems must be designed to detect and respect them. The practical burden is significant on both sides.
The Pending Harmonization
The pending CJEU reference in Case C-250/25 has the potential to resolve this fragmentation. Until that harmonizing guidance arrives, practitioners must navigate a landscape where the same AI training activity may be treated as infringing in Germany (GEMA output-side theory), non-actionable in the UK (Getty jurisdictional principle), and conditionally permitted in other EU member states (DSM Directive Article 4, subject to Kneschke opt-out requirements). Multi-jurisdictional compliance strategies must account for the most restrictive interpretation in any jurisdiction where the client operates.
Part V: The Article 4 Foundation — A Deliberate Regulatory Design Choice
This section reflects both Liga's regulatory analysis and Alex's strategic interpretation.
The EU AI Act entered into force on August 1, 2024, with a staggered implementation timeline stretching to 2027. As of early 2026, its first substantive obligations are already binding, and the penalty framework is among the most aggressive in European regulatory history. But what matters most is not the penalties. It is the sequencing.
Why Literacy Came First
Article 4's AI literacy requirement became binding on February 2, 2025 — the very first substantive obligation to take effect. Simultaneously, the Act's prohibitions on certain AI practices (subliminal manipulation, vulnerability exploitation, social scoring, certain real-time biometric identification) also became binding. But the general-purpose AI model obligations do not take effect until August 2025, and the high-risk system obligations not until August 2026.
This sequencing is not bureaucratic accident. It is regulatory design. The EU AI Act's architects placed literacy first because everything else depends on it. High-risk system oversight requires people who understand what they are overseeing. GPAI transparency requirements mean nothing if the recipients of the transparency cannot interpret it. Prohibited practice identification requires the ability to recognize prohibited practices. Without literacy, every subsequent obligation becomes a checkbox exercise.
This is the regulatory philosophy we build on at TwinLadder. Article 4 does not prescribe a curriculum. It does not mandate a particular depth of technical understanding. It requires that people know enough to use AI responsibly given what they are actually doing with it. And it requires this before anything else in the regulatory stack takes effect.
The Penalty Architecture
The Act's penalty framework reflects the European preference for proportional but potentially enormous maximum penalties. Violations of prohibited AI practices carry maximum fines of EUR 35 million or 7% of total worldwide annual turnover, whichever is higher. Violations of high-risk obligations carry EUR 15 million or 3% of turnover. Violations of other provisions — including Article 4's literacy requirement — carry EUR 7.5 million or 1% of turnover.
For organizations of any size, the turnover-based calculation means penalties scale with revenue. This is a design feature borrowed from the GDPR: large organizations cannot treat fines as a negligible cost of non-compliance. The message is clear — literacy is not a suggestion.
The Implementation Gap
The most significant challenge is not the legislation but the enforcement infrastructure. The Act assigns primary enforcement to national market surveillance authorities, and as of early 2026, many member states have not fully established these authorities. The European AI Office is operational but still developing. The gap between the Act's requirements and enforcement readiness creates a period where obligations are binding but enforcement intensity will vary across member states.
The Digital Omnibus Act, proposed by the European Commission in October 2025, may extend certain compliance deadlines and reduce SME burden. As of early 2026, the proposal is still in the legislative process.
For us, this implementation gap reinforces the argument for proactive preparation. The organizations that build competence now — during the window between Article 4's effective date and full enforcement of high-risk obligations in August 2026 — will be prepared when enforcement infrastructure catches up. The organizations that wait for enforcement actions to clarify the rules will find themselves responding to regulatory expectations they should have anticipated.
Dual Exposure for Professional Services
For professional services firms specifically, the AI Act creates dual exposure. As deployers of AI tools, firms must comply with deployer obligations — AI literacy, transparency when using AI systems that interact with natural persons, and for high-risk AI systems, the full set of deployer requirements. As advisors, firms must counsel their clients on AI Act compliance, which requires expertise that many are still developing.
The firms that build this expertise earliest will capture the advisory market that the AI Act creates — much as firms that developed GDPR expertise early captured the data protection advisory market from 2016 onward. This is not merely compliance. It is competitive positioning.
Part VI: Building the Infrastructure — How TwinLadder Responds
Every enforcement action documented in this white paper tells the same underlying story. A professional or an organization deployed AI without sufficient understanding. A regulator or a court responded. Guidance was issued. The cycle repeated.
We see a different path. Not because we are optimists, but because the European regulatory framework demands a different path. Article 4 does not say "develop AI literacy after your first enforcement action." It says develop AI literacy before you deploy.

There is a deeper structural problem that makes proactive training infrastructure essential, and it goes beyond regulatory compliance.
AI is simultaneously eliminating the entry-level work where professional competence has traditionally developed and automating the senior tasks that require deep judgment. Junior lawyers learn legal reasoning by doing document review, drafting routine contracts, researching case law — precisely the tasks AI handles first. Senior professionals develop judgment through years of accumulated experience — precisely the experience that AI purports to shortcut.
The result is what we call the competence paradox: the very tool that promises to enhance professional productivity is eroding the foundation on which professional competence is built. Organizations that deploy AI without addressing this paradox are building on foundations that will progressively weaken. The enforcement record in this white paper is the early evidence. The cases will accelerate as the competence gap widens.
