On July 29, 2024, the American Bar Association released Formal Opinion 512 — its first formal ethics guidance on generative AI in legal practice. The opinion is careful, thorough, and entirely characteristic of how the American legal profession approaches new technology: it maps existing rules onto new tools and tells lawyers to comply.

What Opinion 512 Gets Right

Opinion 512 deserves credit for several things that other professional bodies have not yet managed.

It refuses to treat AI as exceptional. The opinion applies six existing Model Rules — competence (1.1), confidentiality (1.6), communication (1.4), candor to tribunals (3.1, 3.3), supervisory responsibilities (5.1, 5.3), and reasonable fees (1.5) — rather than creating new AI-specific rules. If AI produces significant time savings, billing practices cannot inflate hours to match what the work would have cost manually. It places supervisory responsibility at the firm level. Partners and managing lawyers are responsible for establishing firm-wide AI policies, training staff, and auditing compliance. Individual lawyer competence is necessary but not sufficient. The obligation is organisational.

Where Opinion 512 Stops

The opinion's limitations are not failures of draftsmanship. They are structural features of the rule-based approach.

It tells lawyers what to do without teaching them how. "Understand the benefits and risks associated with the specific AI tools" is a clear obligation. But how does a lawyer who has practised for twenty-five years without touching a language model actually develop that understanding? The opinion assumes the competence it mandates. It says: verify AI output. It does not say: here is how verification works when the tool produces plausible-looking citations that do not exist.

This is not a minor gap. The ABA Task Force Year 2 Report found that the majority of legal professionals now use AI tools but do not fully understand the practical and ethical challenges that arise from that use. Opinion 512 created obligations for a profession that, by the ABA's own assessment, lacks the capacity to meet them.

It is reactive, not anticipatory. The opinion responds to AI tools that already exist and are already in use. It does not address how lawyers should prepare for tools that will emerge. It does not build a framework for evaluating new AI capabilities as they appear. The European Divergence

Article 4 of the EU AI Act takes a structurally different approach. It does not list rules. It mandates an outcome: providers and deployers of AI systems must ensure that their staff possess "sufficient" AI literacy, "taking into account their technical knowledge, experience, education and training and the context in which the AI systems are to be used."

Three features distinguish this from the ABA approach.

It is universal, not profession-specific. Article 4 applies to every organisation deploying AI — not just law firms, not just regulated professions. The HR director screening candidates with AI tools, the financial controller reviewing AI-generated forecasts, the marketing team using AI for content production — all fall within scope. It is proactive, not reactive. The "sufficient" standard requires organisations to assess whether their staff can use AI responsibly before deployment, not after incidents reveal that they cannot. This inverts the American sequence, where guidance typically follows adoption — sometimes by years.

It demands competence, not just compliance. A twenty-minute e-learning module and a certificate may satisfy a CLE requirement. It does not produce a professional who can identify a hallucinated citation, evaluate whether an AI-drafted memorandum has misconstrued the applicable law, or recognise when a language model is being sycophantic — telling the user what they want to hear rather than what the evidence supports.

The early European evidence supports this distinction. In February 2026, Dutch lawyers received disciplinary warnings for submitting AI-generated briefs containing fabricated case references. A German regional court in Darmstadt ruled an AI-generated expert report inadmissible. These are not failures of rule awareness. These are failures of practical competence — exactly the gap that rule-based approaches leave open.

The Twin Ladder Response

The Twin Ladder methodology was designed to address the space between knowing your obligations and having the capacity to meet them. Assess establishes a baseline: what is this professional's current comfort level, what AI tools are they already using, what verification instincts do they have? This is not a knowledge test. It is a competence calibration.

Learn delivers six focused micro-modules — understanding outputs, verification essentials, the hallucination problem, professional responsibilities, appropriate applications, and quality assurance — each anchored in realistic professional scenarios. Equally important is what it does not teach: neural network architectures, machine learning algorithms, or statistical foundations. These omissions are principled, not concessions to limited attention spans.

Apply builds from guided practice to independent competence through five progressively challenging exercises, each with detailed feedback. The exercises test what professionals can do, not what they can recite.

Certify produces Article 4 compliance documentation, CPD-aligned credits, and a professional credential. The assessment weights scenario analysis at 60% — can the professional exercise judgment in realistic situations? This is a competence evaluation, not a knowledge exam.

Complementary, Not Competing

The practical implication for organisations operating across jurisdictions is clear: you need both.

Opinion 512 (and its state-level implementations) defines the regulatory floor for US legal practice. It tells lawyers what they must do. Without it, there is no enforceable standard.

Article 4 defines the European floor — broader in scope, proactive in orientation, and demanding in its insistence on demonstrated competence rather than rule awareness.

But beneath the regulatory differences lies a shared challenge that neither framework addresses alone. Rules tell professionals what they must do. Training builds the capacity to do it. The gap between the two is where failures occur — the Dutch lawyers who knew they should verify citations but did not know what a hallucinated citation looks like, the firms that adopted AI policies but never taught their lawyers how to apply them.

Closing that gap is not a regulatory problem. It is an educational one. And it is the problem the Twin Ladder methodology was built to solve.
